Welcome to Modiv Wellness. By accessing or using our website, you agree to be bound by these Terms & Conditions. Please read them carefully before using our website or services.
1. Who We Are and Who Does What
This website and your account are operated by Modiv Wellness (“Modiv Wellness,” “we,” or “us”). Your care involves two parties:
Modiv Wellness operates this website and your account, and provides the online intake platform through which you are evaluated by its contracted, licensed healthcare providers. These providers decide whether treatment is medically appropriate. Modiv Wellness also processes payments and provides customer support related to your account and orders. Modiv Wellness itself does not issue prescriptions or dispense medication.
Partell Pharmacy is the licensed pharmacy that issues your prescription, when treatment is medically appropriate, and dispenses and ships your medication. Partell Pharmacy is licensed in all 50 states.
2. Use of Our Website
You agree to use the Modiv Wellness website only for lawful purposes and in accordance with these Terms & Conditions.
You may not use our website in any way that could damage, disable, overburden, or interfere with the operation, security, or availability of the website.
3. Our Services
Modiv Wellness provides access to telehealth evaluation, prescription treatment when appropriate, and related information and resources, as described on our website.
Our services and offerings may change from time to time. We reserve the right to modify, suspend, or discontinue any service or portion of the website when necessary.
4. Eligibility
To use our services, you must:
Be 18 years of age or older
Be located within the United States, in one of the 50 states we currently serve, and give us a delivery address in that state
Provide accurate, current, and complete information
Availability of any treatment depends on clinical eligibility, as decided by the treating provider.
5. Prescription Required; Provider Decisions
Prescription medication is available only after evaluation by a licensed healthcare provider and when determined medically appropriate. If treatment is approved, Partell Pharmacy issues the prescription.
The provider decides whether treatment is medically appropriate. The provider may decline to approve treatment, may ask for more information, or may recommend a different treatment or a visit to another healthcare provider.
The final medication, formulation, strength, and quantity are determined through the provider’s evaluation and the prescription issued by Partell Pharmacy. You cannot choose or change your dose through this website.
Selecting a product, strength, or quantity, or paying, does not guarantee that medication will be prescribed.
Medication is dispensed and shipped only after a provider has approved treatment and Partell Pharmacy has issued the prescription. You cannot obtain prescription medication without provider review.
6. Medical Information & Care
Information provided through the Modiv Wellness website is intended to support your understanding of our services and should not be considered a substitute for professional medical advice, diagnosis, or treatment.
Healthcare services provided through Modiv Wellness are subject to appropriate clinical evaluation and may not be suitable for everyone. If you are experiencing a medical emergency, call 911 or seek immediate medical attention through your local emergency services. Do not use this website in an emergency.
7. Compounded Medications
Compounded medications are prepared by licensed compounding pharmacies pursuant to applicable law. Compounded medications are not FDA-approved and have not been reviewed by the FDA for safety, effectiveness, or quality before marketing.
8. User Information and Your Account
When submitting information through our website, you agree that the information you provide is accurate, current, and complete. This includes your health history, current medications, contact details, and delivery address.
You are responsible for keeping your information up to date, for keeping your account login private, and for activity under your account. Giving inaccurate or incomplete health information can affect your safety and the provider’s decisions.
9. Evaluations and Consultations
Your evaluation begins when you submit your online health intake questionnaire. One of Modiv Wellness’s contracted, licensed providers will review your intake and, if additional information is needed to make a safe and informed treatment decision, may contact you by secure message, phone, or video before proceeding.
If you do not respond to a request for additional information within a reasonable time, your evaluation may be paused or closed, and you may need to resubmit your intake to continue.
10. Payments, Recurring Charges, and Cancellation
Payment is required for products or services according to the prices displayed or communicated at the time of purchase. Our pricing page explains what your price includes.
Your payment method is authorized when you place your order. Your card is charged once a provider has reviewed your intake and approved treatment.
No charges under this Section recur automatically. You will only be charged when you place a new order.
There is no separate provider evaluation or screening fee. You are only charged for the product or service you order.
Refunds are described in our Returns & Refunds policy. Shipping is described in our Shipping Policy.
Modiv Wellness reserves the right to correct pricing or other listing errors and to update prices, services, or offerings when necessary.
By placing an order you authorize Modiv Wellness to charge the payment method you provide. Charges will appear on your statement as “Modiv Wellness.”
11. Intellectual Property
All content appearing on this website, including text, graphics, logos, images, photographs, designs, videos, and other materials, is owned by or licensed to Modiv Wellness unless otherwise stated.
You may not reproduce, distribute, modify, republish, or otherwise use our content without prior written permission.
12. Privacy
Your use of our services is also governed by our Privacy Policy, which explains how your information, including health information, is collected, used, and shared with Partell Pharmacy and used by Modiv Wellness’s contracted licensed providers to evaluate and treat you.
Our Privacy Policy also describes how Protected Health Information (PHI) is safeguarded in accordance with the Health Insurance Portability and Accountability Act (HIPAA), to the extent HIPAA applies to the parties involved in your care.
13. Third-Party Services & Links
Our website may contain links to third-party websites, platforms, or services.
Modiv Wellness does not control and is not responsible for the content, availability, security, privacy practices, or policies of third-party websites or services.
14. Disclaimer of Warranties
We make reasonable efforts to keep the information on our website accurate and current. However, we do not guarantee that website content will always be complete, accurate, current, or free from errors.
Our website and its content are provided on an “as available” basis. Your use of the website is at your own discretion and risk. This does not limit the professional responsibilities that our licensed providers owe to you as a patient.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Modiv Wellness will not be responsible for indirect, incidental, consequential, or other damages arising from or related to your use of the website or services.
This limitation of liability applies to Modiv Wellness’s operation of the website and platform. It does not extend to Partell Pharmacy, which is independently responsible for its own acts and omissions in issuing prescriptions and in dispensing and shipping medication, and it does not limit the professional responsibility our licensed providers owe you for the clinical care they provide. Nothing in these Terms & Conditions is intended to limit any rights or protections that cannot legally be limited.
16. Changes to These Terms
Modiv Wellness may update these Terms & Conditions from time to time to reflect changes to our services, practices, or applicable requirements.
Updated terms will be posted on this page with a revised “Last Updated” date.
Your continued use of the website after changes are posted constitutes acceptance of the updated Terms & Conditions.
